Terms of Service

FableAuri is private hostingfor audiobook files you already have the right to store and play, plus a player for authorized household listeners. It is not a store, marketplace, lending library, or public distribution platform. We do not sell audiobooks, and we do not grant you copyright licenses in anyone else’s works.

You must be at least 18 to create a paid account and enter this contract. Invited listeners with their own login must be at least 13.

Account holders may create household listening profiles for family members, including children under 13. Those profiles have no separate login. You are responsible for profiles you create and for their use of the library, including titles you make available to kid profiles.

You must provide accurate account information and keep your password confidential. You are responsible for activity under your account and for listeners and profiles you authorize. Notify us if you believe the account has been misused.

Paid plans are billed in advance through Stripe, monthly or yearly as you choose. Subscriptions renew automatically at the then-current rate until you cancel. You can cancel in Settings via the Stripe billing portal. Cancellation takes effect at the end of the current billing period; you keep access until then.

Fees are non-refundable except where the law requires a refund. If we change prices, we will charge the new price on the next renewal after notice (including by email or in the portal).

If payment fails, we may suspend access until the subscription is restored. After a subscription ends, we may retain hosted library files for up to 30 days and then permanently delete them. Keep your own copies. FableAuri is not an archival backup service.

You retain whatever rights you already have in files and metadata you upload (“Library Content”). You — not FableAuri — are responsible for that content.

You represent and warrant that you have all rights needed to upload, store, and play Library Content through the Service, including for every household listener you authorize, and that doing so does not infringe copyright or other rights.

You grant us a limited license to host, store, transmit, and play Library Content solely to operate the Service for your account (including authorized seats and device playback or offline copies you choose to save). We do not claim ownership of your files.

You may not:

• Upload or share material you do not have the right to store and play
• Use the Service as a public file host, pirate library, or unauthorized distribution channel
• Exceed your seat limit by sharing logins, adding profiles beyond your plan, or inviting people beyond the plan
• Probe, disrupt, or reverse engineer the Service except as allowed by law
• Upload malware or attempt to gain unauthorized access
• Misuse FableAuri branding or imply we sell or license audiobooks

We may remove content or suspend or terminate accounts that violate these terms, including after copyright notices as described in our DMCA / Copyright Policy.

A seat is any person you authorize to listen — whether they have their own login or a household profile you create (for example a child profile). Extra seats are for people in your household, not for the public. You must not advertise access, charge others for access, or treat FableAuri as a sharing service for people who are not allowed to listen to your copies.

Kid profiles can be restricted from certain titles you mark in your catalog. You are responsible for what kid profiles can access.

If you believe content hosted on the Service infringes your copyright, send a notice to our designated agent as described in the DMCA / Copyright Policy. Do not use the general contact form for takedown notices. We will terminate, in appropriate circumstances, the accounts of repeat infringers.

If you save titles for offline use, those copies live on your device. You remain responsible for them. Deleting a book from the Service or ending a subscription does not automatically erase copies already on a device.

We aim to keep the Service available, but we do not guarantee uninterrupted access. We may change features, plans, storage limits, or these terms. The Service is provided “as is” without warranties of any kind, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement, to the fullest extent permitted by law.

You may stop using the Service and cancel your subscription at any time via the Stripe billing portal in Settings. Cancellation does not delete the library by itself. To request deletion of a library or of personal information, email hello@fableauri.com. We (including staff) may close a library, and we may suspend or terminate access if you breach these terms, if required by law, or if we discontinue the Service. After termination, the license you granted us ends except for copies we must keep for legal or operational reasons, and hosted Library Content may be deleted after the retention period above.

To the fullest extent permitted by law, Mardis Studio LLC is not liable for indirect, incidental, special, consequential, or punitive damages, or for lost data, lost profits, or replacement of Library Content. Our total liability for any claim relating to the Service is limited to the amount you paid us for the Service in the 12 months before the claim. Some jurisdictions do not allow certain limitations; in those places our liability is limited to the maximum extent permitted.

You will indemnify and hold Mardis Studio LLC harmless from claims, damages, and reasonable legal fees arising from your Library Content, your use of the Service, or your breach of these terms, including copyright claims about files you uploaded or seats you authorized.

These terms are governed by the laws of the State of Texas, without regard to conflict-of-law rules. Courts located in Texas will have exclusive jurisdiction, except that we may seek injunctive relief in any forum to protect the Service or intellectual property.

We may update these terms. The “Last updated” date will change when we do. If a change is material, we will provide reasonable notice (for example by email or a notice in the portal). Continued use after the effective date means you accept the revised terms.
