DMCA / Copyright Policy

Mardis Studio LLC d/b/a FableAuri operates the FableAuri website and the FableAurihosting service (together, the “Service”). Subscribers may upload audiobook files and related library materials to private hosting space. This page explains how copyright owners may notify us of alleged infringement, how subscribers may file a counter-notification, and how we handle repeat infringement.

This policy is provided to comply with the Digital Millennium Copyright Act, 17 U.S.C. § 512. It is a notice procedure, not legal advice.

Filing a DMCA takedown notice

To be valid under 17 U.S.C. § 512(c)(3), a notice of claimed infringement must include all of the following:

  1. A physical or electronic signature of the copyright owner, or of a person authorized to act on the owner’s behalf.
  2. Identification of the copyrighted work claimed to have been infringed. If multiple works are covered by one notice, a representative list is sufficient.
  3. Identification of the material that is claimed to be infringing, and information reasonably sufficient for us to locate it. For FableAuri, include the public URL if any, the subscriber account or library name if known, and the specific title, file name, or other locator of the hosted item.
  4. Your contact information: name, mailing address, telephone number, and email address.
  5. A statement that you have a good-faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.
  6. A statement that the information in the notice is accurate, and under penalty of perjury, that you are authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.

What we do after a valid notice

When we receive a notice that substantially complies with the requirements above, we will promptly remove or disable access to the identified material and take reasonable steps to notify the subscriber who stored it. We may also share the notice with that subscriber so they can decide whether to file a counter-notification.

Counter-notification

If you are a subscriber and you believe material was removed or disabled by mistake or misidentification, you may send a counter-notification to the designated agent. Under 17 U.S.C. § 512(g)(3), it must include:

  1. Your physical or electronic signature.
  2. Identification of the material that was removed or to which access was disabled, and the location where it appeared before it was removed or disabled.
  3. A statement under penalty of perjury that you have a good-faith belief that the material was removed or disabled as a result of mistake or misidentification of the material to be removed or disabled.
  4. Your name, address, and telephone number, and a statement that you consent to the jurisdiction of the Federal District Court for the judicial district in which your address is located (or, if your address is outside the United States, for any judicial district in which Mardis Studio LLCmay be found), and that you will accept service of process from the person who provided the original notice or that person’s agent.

If we receive a valid counter-notification, we may restore the material unless the original complainant files an action seeking a court order against you, as provided in § 512(g).

Repeat infringer policy

FableAuri is private hosting for audiobook owners, not a public marketplace. Subscribers must have the right to store and play the files they upload. We will terminate, in appropriate circumstances, the accounts of subscribers who are repeat infringers. We may also terminate or suspend an account after a single notice when the circumstances warrant it.

Misrepresentation

Under 17 U.S.C. § 512(f), any person who knowingly materially misrepresents that material is infringing, or that material was removed or disabled by mistake or misidentification, may be liable for damages, including costs and attorneys’ fees.
